This essentially never happens, since by Spanish law, every payment you make before completion must be protected by a bank guarantee or insurance (aval bancario or seguro de caución), issued in your name for your exact payments. We, together with a trusted lawyer, will always check that this guarantee exists before you pay anything.
You pay a reservation deposit, then staged payments during construction, then the remaining amount at the notary on completion. Each stage payment is covered by the bank guarantee. We will always confirm the bank guarantee is present at every stage, so your money is secured the whole way.
Yes, and it is common. You get a Spanish tax number (NIE) and appoint a trusted lawyer, whom we can recommend. With your approval, the lawyer can sign everything for you using a power of attorney. So you can complete the whole purchase from abroad. We arrange viewings in person or by video, and we coordinate the lawyer, notary and developer for you. The lawyer is independent. They work for you, not for us or the developer.
A new build has VAT (IVA) 10% plus stamp duty (AJD, 1.2% in Andalucia). A resale property has a transfer tax (ITP, 7%) instead. On top you pay notary, land registry, and legal fees. Budget roughly 12 to 14% above the price. You'll have the full breakdown in writing from your lawyer.
Delays are common, so we give you realistic timelines, not optimistic ones. The contract sets a completion date with a grace period, and your bank guarantee keeps protecting your money the whole time. A delay can give you the right to a full refund with interest. We keep you updated through construction.
During handover, we help you do a defect check and make sure the developer fixes everything. Spanish law then covers you for 1 year on finishes, 3 years on installations, and 10 years on the structure (seguro decenal). You are not left alone with problems after you move in.
In most areas, you can rent short-term with a tourist licence registered with the Junta de Andalucía, though now some communities restrict it.
